SUMMARY OF RESPONSIBILITIES:
ESSENTIAL JOB FUNCTIONS
- Assist attorneys and legal assistants in all phases and aspects of patent due diligence analysis for corporate financial transactions, mergers and acquisitions and licensing matters
- Perform patent audits to determine the scope, legitimacy, enforceability, ownership, value, status and transferability of patent assets
- Complete patent inventory for granted and pending patents, including owned, licensed, domestic and foreign patent rights
- Review all documents including assignments, licenses, employment agreements, consulting agreements, maintenance agreements, joint ventures, distribution agreements, security documents and UCC filings to determine ownership, validity and transferability of assets
- Evaluate expiration dates, filing and maintenance fees, missed payments, changes in small entity status, pending litigation, interferences, re-examinations, reissues or oppositions to determine status and value of patents
- Evaluate claim language, patent specification and prosecution history of patents to determine scope of protection
- Prepare supporting documents based on research; make recommendations for amendments to cover products or about deficiencies determining transaction prices
- Perform freedom to operate searches to determine rights to exclude third parties or identify blocking patents
- Organize, prepare and manage electronic and paper transaction documents and files
- Conduct research regarding the availability of all types of patents, trademarks and corporate names
- Perform title assignment and ownership searches using Dialog and outside searching agents
- Compose patent, trademark, copyright and domain name schedules
- Record documents with the USPTO and US Copyright Office
- Handle all aspects of daily docketing, including: review mail and calendar dates; verify deadlines and input into the docket system; monitor docket daily for filing updates and deadlines and communicate same to attorneys.
- Review incoming correspondence from U.S. Patent and Trademark Office for docket information
- Prepare documents for filing, including: patent applications, Preliminary Amendments, Information Disclosure Statements, Responses to Missing Parts, Assignments, Amendments, payments of Issue Fees
- Proofread issued patents and prepare related documents
- Prepare necessary documents and process foreign patent applications; maintain foreign filing docket
- Investigate a range of topics for background information from SASM&F library, the New York Public Library, specialized libraries and patent organizations such as USPTO, EPO, WIPO, UPO, INPADOC and Derwent WPI
- Conduct research using various research tools, including the Internet, Westlaw, LexisNexis, Dunn & Bradstreet, PACER, Reedfax, Court Express and USPTO
Required for this job
- 6+ years patent due diligence experience within a major law firm
- Strong patent analysis skills
- Ability to determine scope and value of patents as it relates to corporate transactions
- Exceptional researching skills
- Proficiency with MS Word and Excel, Concordance, Relativity and DocuMatrix, Westlaw, LexisNexis, Dunn & Bradstreet, PACER and other court-related websites, Reedfax, Court Express and USPTO
- Bachelor's degree
- Available to work extensive well paid overtime, including weekends and great travel

SUMMARY OF RESPONSIBILITIES:
- The legal assistant works with all of the attorneys on the matter from the beginning through trial, arbitration, or ITC, managing the flow of information and ensuring adherence to best practices
- Work in all phases of the discovery process, from collection of documents from the client to the production of documents to other parties.
- Prepare for depositions by arranging the preparation of witness files, compiling and organizing exhibits, and arranging the technical logistics with court reporting agencies. Research prior testimony and publications, and track materials sent to the experts. Manage deposition transcripts and exhibits, and maintain searchable computer databases of testimony.
- Work with the attorneys during the briefing process by checking the legal and fact cites, and ensuring proper formatting style. Responsible for assembling and organizing the exhibits and supporting documents as well as arranging for filing with the court and serving on all parties.
- In preparation for trial, work with the attorneys, experts, and client to identify and compile potential trial exhibits, generate trial exhibit lists, and track objections to both parties exhibits. Prepare deposition designations, and compile Pretrial Orders and other submissions.
- Coordinate the scheduling of witnesses for preparation and testimony. Work with trial consultants on graphics, linking deposition videos and other demonstratives, and coordinate courtroom logistics with courthouse personnel.
- At trial, the legal assistant team prepares materials for each day’s examinations, tracks the use and admission of exhibits, tracks and reviews witness testimony, and delivers and picks up all materials at the courtroom each day.
ESSENTIAL JOB FUNCTIONS
Litigation Case Management
- Obtains information and materials from IP vendors and government agencies, such as the US Patent & Trademark Office
- Certified patents
- Patent file histories and wrappers
- Manages document production processes - hard copy, electronic, etc.
- Collects material from client, opposing parties, and third parties (hard copies, electronic data, physical evidence)
- Maintains chain of custody
- Prepares and maintains the tracking log of materials received and produced through the discovery process
- Designs and implements document review systems
- Prepares privilege logs
- Manages logistics of production of documents - hard copy, images, native
- Substantive Research
- Analyzes documents and materials
- Performs factual research
- Compiles information into charts, graphs and timelines
- Researches prior testimony and publications of opposing experts
- Researches rules of procedure for relevant court venues, and assures adherence thereto
- Coordinates preparation and filing of briefs and legal documents
- Drafts routine filings (e.g. attorney appearances, notices of filings, notices of motions)
- Legal cite checking, shepardizing (Westlaw, Lexis)
- Compiles appendices and exhibits
- Blue Book formatting, application of local rules
- Prepares and submits electronic court filings
- Interacts with outside entities (clients, government agencies, expert witnesses, consultants, other law firms, opposing parties, court personnel, etc.)
- Manages litigation support systems
- Databases (Concordance, Summation, Access, etc)
- Transcript management systems (LiveNote)
- Manages preparation for witnesses and depositions
- Manages preparation of witness & subject files
- Assists in preparation of witness outlines
- Manages technical logistics for depositions (remote hookups, electronic transcripts, videography, synchronization)
- Manages trial preparation and trial support
- Compiles and tracks trial exhibits
- Prepares pretrial documents
Sets up and manages trial offices and trial support (e.g. remote office setup and logistics)
REQUIRED for this job
- At least 6+ years IP experience in a large law firm
- At least 3+ years litigation experience
- At least 2 trial, and several hearings (Markman, summary judgment, preliminary injunction )
- Must have knowledge of district court procedures and ITC procedures
- Bachelor’s degree required. Travel and overtime may be required
